The Garage Taphouse Food Delivery Service Terms

Welcome to The Garage Taphouse! By using our food delivery services, you agree to the following terms and conditions. If you do not agree with these terms, please do not use our services.

1. Acceptance of Terms

By accessing or using our website, mobile app, or services, you confirm that you are at least 18 years old and have the legal capacity to enter into these terms. If you are using our services on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2. Services Provided

The Garage Taphouse offers food delivery services that allow users to order food from our restaurant only, through our platform.

3. Ordering Process

  • Users can place orders through our website www.TheGarage.pub.
  • All orders are subject to acceptance by The Garage Taphouse. We reserve the right to refuse or cancel any order for any reason.
  • Upon placing an order, users will receive an order confirmation via email or in-app notification.

4. Pricing and Payment

  • Prices for menu items are determined by our Point of Sale System and may vary. All prices are subject to change without notice.
  • Users are responsible for paying the total amount of the order, including taxes, fees, and delivery charges.
  • Payments can be made via accepted payment methods listed on our platform. By providing your payment information, you authorize The Garage Taphouse to charge your selected payment method.

5. Delivery

  • Delivery times are estimates and may vary based on factors such as restaurant preparation time, traffic conditions, and the availability of delivery drivers.
  • Users must ensure they provide accurate delivery addresses. The Garage Taphouse is not responsible for delays or failure to deliver due to incorrect information.

6. Cancellations and Refunds

  • Users can cancel orders before they are confirmed by the restaurant. Once confirmed, cancellations may not be possible.
  • If a order is canceled after the order is confirmed, or if we are unable to deliver your order due to incorrect delivery info or a No-Show from the customer, a cancelation fee of 10% of the order total is applied, and our refund policy applies.
  • Refunds are issued at the discretion of The Garage Taphouse and will follow our refund policy outlined in the app/website.
  • Our refund policy: All refunds are issued using the same method used when the order was created. If a refund is issued, it will be done withing 24hours of the transaction. If a order is subject to a cancelation fee, a partial refund will be issued minus the fee amount. All refunds are at the sole discretion of The Garage Taphouse.

7. User Responsibilities

  • Users agree to provide accurate, current, and complete information when placing orders.
  • Users must not misuse our services or engage in any fraudulent or unlawful activities.
  • Users are responsible for their account activity and must maintain the confidentiality of their account information.

8. Limitation of Liability

The Garage Taphouse shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Garage Taphouse, its affiliates, officers, directors, and employees from any claims, liabilities, damages, or expenses arising out of your use of our services or violation of these terms.

10. Governing Law

These terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles. Any disputes arising from these terms will be resolved in the state or federal courts located in Albany, OR / Linn County.

11. Changes to Terms

We may update these terms from time to time. We will notify users of any significant changes via email or through our platform. Continued use of our services after any changes constitute your acceptance of the new terms.
